General Terms and Conditions

(Allgemeine Geschäftsbedingungen) 

1. Scope

The following general terms and conditions apply to the contractual relationship between the attendant (“Attendee”) of the SingularityU Germany Summit (“SU Summit”) and the Curages Conference Management GmbH (“Curages”), who is organizing the event.
Attendee’s conflicting or deviating terms and conditions are not a part of the agreement unless Curages has expressly agreed to their application in writing. This also applies if Curages performs its services without reservation and in full knowledge about conflicting or deviating terms and conditions by Attendee.

2. Provider and Contractual Partner

3. Registration/Confirmation

You may register as an Attendee to the SingularityU Germany Summit 2017 via Eventbrite or via our shop on our SingularityU Germany website. The contract about the registration becomes legally valid and binding upon our written confirmation (email is sufficient).  

4. Right of Withdrawal for Consumers

In case you are a consumer under section 13 of the German Civil Code (i.e. if you sign up to attend the SingularityU Summit as a natural person for purposes that predominantly are outside your trade, business or profession), by law you have the following right to withdraw from the contract:

Right of Withdrawal
You have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us about of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the below model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
In case you have demanded that the services begin during the withdrawal period you shall have to pay an appropriate amount of money equivalent to the percentage of the service which has been rendered by us until such time as you have informed us about you exercising your right of withdrawal, compared to the full scope of contractual services.

5. Scope of service, changes of key note speakers and program, cancellation of the event by the organizer

The attendance fee is per person and plus VAT. It covers attendance of the SingularityU Summit conference on 3rd and 4th of May 2017, lunch and beverages during breaks.
Curages reserves the right to replace the announced key note speakers by others and to make changes to the conference program as necessary, while maintaining the overall character of the event.
The event may be cancelled for a compelling reason, for example in case of force majeure, or illness or otherwise inability of a key note speaker to attend, or disruptions at the place of the event, or because of an insufficient number of attendees. In such case the attendees shall be informed without delay. A cancellation because of an insufficient number of attendees shall be communicated no later than two weeks in advance of the scheduled date of the event. The attendance fee shall be reimbursed in such cases. The shall be no claim for compensation of expenses for travel or overnight accommodation, unless the cause for the cancellation has been caused by Curages intentionally or by gross negligence.
In the event that the performance of the event is impaired, Curages endeavors to take all reasonable measures to help to cure or alleviate the disruption.

6. Payment of the attendance fee, default, set-off

The attendance fee is payable upon receipt of the invoice or via credit card.
Payment by sending cash or checks cannot be accepted; Curages does not accept responsibility if such are lost.
The Attendee may set-off only against claims which are validly determined by a court of law or confirmed  in writing by Curages. The Attendee may exercise a right of retention only insofar as his counter-claim is based on the same contractual relationship.

7. Cancellation by the Attendee, Substitutions

The attendee may cancel his registration without cost, and receive a full refund of the attendance fee, up until 14 days before the scheduled date of the event. No reasons need to be given. Such cancellation by the attendee must be in writing. In case the attendee cancels his registration at any date after the April 14th 2017, he shall pay the full ticket price.
Tickets to SingularityU Germany Summit are personalized. Substitutions are allowed with the written permission of the original registrant, without additional cost. For substitution requests please write an email to: ticketing@singularityugermanysummit.org

8. Copyright

All conference papers provided by Curages are protected by copyright. The Attendees are granted a non-exclusive, not transferable right of use, for personal use only. The conference papers or parts thereof may not be copied, distributed or made publicly available. Any copyright notices or markings or trademarks may not be removed.

9. Liability

The events are diligently prepared and presented by competent speakers. Curages shall not be liable in regard to the content of the conference papers and the information communicated through the lectures and discussions or otherwise presented at the event, whether it is how up-to-date the information is or in regard to the correctness or completeness.

10. Data Protection

The personal data of the Attendee which the Attendee communicates to Curages on occasion of his registration and attendance of the event are processed by Curages for the purpose of processing the registration and organising the event.

11. Recordings

Audio and image recordings will be made at our events. By participating in these events, you agree that such recordings may be made of you while in attendance and that these recordings may be used in all known media channel (TV, online, print, etc.) for an unlimited scope and time frame.

12. Applicable law and venue

This agreement and the entire contractual relationship between Curages and Attendee are subject to the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), even if the Attendee has his personal or company domicile abroad. In relation to consumers, this choice of law shall only apply insofar as the consumer is not deprived of such protection which is provided by mandatory statutory provisions, i.e. which cannot be waived by private agreement, of the country in which the consumer has his habitual residence. The Attendee is deemed a consumer if the transaction in question (e.g. the registration for the event) is made by the Attendee as a natural person for purposes that predominantly are outside his trade, business or profession.
The courts at the domicile of Curages shall have exclusive jurisdiction to determine any disputes between the Parties arising under this Agreement, if the Attendee is a merchant (Kaufmann) or legal entity under public law (juristische Person des öffentlichen Rechts) or a special fund under public law (öffentlich rechtliches Sondervermögen). This choice of venue shall also apply in the event that the Attendee does not have a habitual place of residence in Germany, or, following the conclusion of this Agreement, the Party to whom claim is to be laid relocated his place of residence or habitual place of abode to a location outside of Germany, or for the event that the Party’s place of residence or habitual place of abode is not known at the time the proceedings are brought in the courts. This choice of venue shall not apply, however, in case the Attendee is a consumer and has his domicile or habitual place of residence in a member state of the European Union. In such case, a law suit must be filed at the competent local court of such member state.
